Who this is for — and who it isn't
This guide is for international students whose Student Route (formerly Tier 4) visa application has been refused by UKVI. It covers the three options available after refusal: admin review, fresh application, and PAP letter. It explains the deadlines, what each process can and cannot achieve, and how to read a refusal notice to identify the correct next step.
This guide is not for refusals of Skilled Worker, Graduate Route, family visas, or visit visas — each has its own refusal and review framework. It is also not a substitute for immigration legal advice when the refusal involves complex grounds such as deception allegations, general grounds for refusal under Part 9, or a previous adverse immigration history. If your refusal notice cites paragraph 9.4.1 (false representations) or 9.7.1 (previous breach of immigration laws), consult a regulated immigration adviser before responding — the consequences of an adverse finding on these grounds extend beyond the current application.
Read the refusal notice first: what the paragraph numbers mean
The UKVI refusal notice is structured around Immigration Rules paragraphs. The key paragraphs for Student Route refusals are:
- ST 1.1-ST 1.5 (valid application): The application was not validly made — fee not paid, biometrics not enrolled, form incomplete, or passport not provided. Usually a correctable error in a fresh application rather than an admin review issue.
- ST 3.1-ST 3.3 (entry clearance requirements): Eligibility under the Student Route was not demonstrated. This is the most common refusal paragraph and covers the substantive requirements.
- ST 12.3-ST 12.4 (financial requirement): Maintenance funds were not demonstrated at the required level, for the required period, or in the required format. Often involves the 28-day rule — the funds must have been held for 28 consecutive days ending no more than 31 days before the application date. A one-day breach results in refusal.
- ST 17.1-ST 17.3 (English language): The English language requirement was not met. Common triggers: test not on the SELT list, test expired, score below B2, or test provider not approved for the applicant's country of test location.
- ST 22.1-ST 22.6 (credibility interview): The credibility interview raised concerns about genuine student intent, and UKVI was not satisfied. The refusal notice will quote specific answers from the interview record.
- ST 27.1-ST 27.3 (academic progression): For applicants who have previously studied in the UK, the new course does not demonstrate academic progression from previous study.
- Part 9 (general grounds for refusal): Covers suitability issues — criminality, deception, previous breaches, NHS debt over £500. Refusals under Part 9 are among the most serious and require specialist advice.
Option 1: Admin review — when the decision was wrong on the evidence you sent
Admin review is the correct route when the refusal contains a demonstrable caseworking error. Examples: UKVI states the CAS was not submitted, but the CAS reference number was on the application form and the CAS status was "Assigned" on the date of decision. UKVI states maintenance funds were £500 short, but the bank statement shows a closing balance above the required amount for every day of the 28-day period. UKVI states the English test was not on the SELT list, but the SELT unique reference number resolves to an approved test and provider on the Home Office's online verification tool.
Admin review cannot correct an error in your own evidence. If the bank statement genuinely showed only 27 days of fund maintenance instead of 28, an admin review will not succeed — UKVI correctly applied the rule to the evidence you submitted. In that case, a fresh application with a new bank statement covering the full 28 days is the correct path.
File the admin review online. The application must state which caseworking error was made, referencing the specific paragraph of the refusal notice and the specific document in your application that the caseworker overlooked or misinterpreted. A generic "the decision was wrong" submission will not succeed. Be precise: "The refusal notice at paragraph 3 states that maintenance funds for the period 1-28 June were not demonstrated. The bank statement at page 14 of my application shows a closing balance of £12,006 on each day from 1-28 June, satisfying the £12,006 requirement for inner London study as stated in Appendix ST 12.3."
Option 2: Fresh application — when your evidence needs correction
A fresh application is the appropriate route when your evidence genuinely fell short and can be corrected. You must pay the application fee and Immigration Health Surcharge again. The new application is assessed on its own merits — the prior refusal is not, by itself, a ground for refusing the new application, but you must disclose the prior refusal on the form.
Before reapplying: identify exactly what was deficient and fix it. If maintenance was short by one day, get a new bank statement showing a full 31-day window. If the CAS was withdrawn, confirm with your sponsor that a new CAS has been assigned and that the sponsor has not reported you to UKVI. If the English test was not a SELT, take an approved SELT and attach the new results. If the credibility interview raised concerns, prepare for a second interview by reviewing the questions that were flagged and preparing specific, verifiable answers. Reapplying with the same evidence that led to the refusal will result in a second refusal — and a pattern of refusals can raise credibility concerns in future applications across any visa category.
Option 3: Pre-Action Protocol (PAP) letter — when the process itself was unlawful
A PAP letter is a formal pre-litigation step sent to the Government Legal Department. It alleges that UKVI's decision was unlawful on public law grounds and requests that the decision be withdrawn and remade. PAP letters are appropriate when the decision-making process was procedurally defective, not merely when the outcome was unfavourable. Examples: UKVI refused the application based on a credibility interview that was not audio-recorded and for which no transcript was provided, making meaningful review impossible. UKVI refused based on a policy that was not published at the time of application. UKVI refused without giving the applicant an opportunity to address an adverse credibility finding (a procedural fairness breach).
A PAP letter is not a substitute for admin review or a fresh application. It is a serious step that should be drafted or reviewed by a regulated immigration adviser or solicitor. If the PAP letter is ignored or rejected, the next step is judicial review in the Upper Tribunal — a costly and time-consuming process with no guarantee of success. For most Student Route refusals, admin review or a fresh application is the more practical and faster route.
Worked example
Chinara is a Nigerian student who applied for a Student Route visa to study an MSc in Data Science at the University of Manchester (inner London maintenance rate does not apply — she needs the standard maintenance amount for study outside London, which she confirms on the GOV.UK Student Route page at the time of application). She submitted a bank statement from her father's Access Bank account showing a closing balance above the required amount. UKVI refused the application under ST 12.3: the statement covered the period 3 June to 30 June — 27 days, not 28. The one-day gap made the financial evidence non-compliant. Chinara's admin review was correctly refused because UKVI applied the rule correctly to the evidence she submitted — there was no caseworking error. She obtained a new bank statement from her father covering 1-31 July showing a balance above the required maintenance level throughout, obtained a new CAS from Manchester (the original CAS was withdrawn when the refusal was issued), and filed a fresh application. The new application was approved. The process added approximately 8 weeks to her timeline and cost an additional application fee and IHS, but the outcome was correct because she fixed the evidence gap before reapplying rather than challenging a correct decision.
Common mistakes
- Filing admin review when a fresh application is needed. If your evidence was genuinely deficient, admin review will waste 28 days and leave you with the same refusal. Read the refusal notice carefully: does it say "the documents you submitted do not show X" (fresh application) or "you have not provided document Y, which is at page Z of your application" (admin review)? The distinction determines the correct route.
- Missing the admin review deadline. The 14-day (in-country) or 28-day (out-of-country) clock is strict and begins on the date the refusal notice was issued. Bereavement, illness, or waiting for a solicitor to return from leave are not accepted as reasons for late filing. File the review within the deadline even if you do not yet have all supporting arguments — you can supplement the submission later if UKVI requests further representations, though this is not guaranteed.
- Reapplying without understanding what went wrong. A second refusal on the same or similar grounds creates a pattern that raises credibility concerns. If you are unsure what specific paragraph was breached and how to fix it, get the refusal notice reviewed by an immigration adviser before reapplying.
- Assuming a PAP letter is a shortcut. PAP letters are appropriate in a narrow set of circumstances and are not a backdoor appeal. Most Student Route refusals are correctly decided on the evidence. Filing a PAP letter without valid public law grounds wastes time and money and delays the correct remedy (fresh application or admin review).

When to get a paid review
Student Route refusal document review
A refusal letter is dense and the correct next step is not always obvious. A refusal review examines the specific Immigration Rules paragraph cited, the evidence you submitted, and whether admin review, fresh application, or a PAP letter is the strongest path forward. You get a written assessment with a recommended strategy.

What is the deadline for an admin review after a Student Route refusal?+
14 calendar days from the date the refusal notice was received if applying from inside the UK; 28 calendar days from the date the refusal notice was received if applying from outside the UK. The deadline is strict — late applications are rejected without consideration of the merits. The date of receipt is the date the refusal email or letter was sent, not the date the applicant read it. File the admin review application online through the GOV.UK portal.
Can I submit new evidence in an admin review?+
No. An admin review examines whether the original decision contained a caseworking error based on the evidence that was before the decision-maker at the time. New documents, new bank statements, or new CAS letters cannot be introduced. If the refusal was correct on the evidence submitted — for example, the maintenance funds were genuinely short — an admin review will not overturn the decision. In that case, a fresh application with corrected evidence is the appropriate route.
What is the difference between admin review and a PAP letter?+
Admin review is a statutory remedy under Appendix AR of the Immigration Rules — it asks UKVI to reconsider whether a caseworking error was made. A Pre-Action Protocol (PAP) letter is a step before judicial review — it alleges that the decision was unlawful on public law grounds (procedural unfairness, irrationality, failure to follow published policy). A PAP letter does not pause the admin review or re-application clock. Admin review is the correct first step for most Student Route refusals; a PAP letter is appropriate when the decision-making process itself appears procedurally defective.
Will an admin review affect future applications?+
Filing an admin review does not create a negative immigration record. If the review is successful, the refusal is overturned and the visa is granted. If unsuccessful, the refusal stands, and the applicant must declare it on future applications. The refusal itself (not the admin review) is the item that must be disclosed. An unsuccessful admin review followed by a fresh application with corrected evidence is a common and non-prejudicial sequence.
How long does admin review take?+
UKVI aims to decide within 28 calendar days, but complex reviews can take longer. During the review, the applicant's immigration status does not change — an in-country applicant with valid leave remains on that leave; an out-of-country applicant has no status in the UK. If the review is successful, UKVI will issue the visa or vary the refusal. If the review is pending beyond 28 days, the applicant can contact UKVI through the complaints procedure, though this rarely accelerates the review.
Can I travel while my admin review is pending?+
For in-country applications: section 3C leave does not apply to admin reviews. If your previous leave expires while the admin review is pending, you become an overstayer. For out-of-country applications: travel to the UK is not permitted on the refused application, and attempting to enter as a visitor while an admin review is pending may result in refusal at the border. Wait for the review outcome before making travel plans.
